There are three types of bankruptcy we can assist you with:
Chapter 7 ("Fresh Start Bankruptcy"): This type of bankruptcy is thought to be the most common form. It can
be used by individuals, couples and businesses. It is also called "Liquidation."
Chapter 7 typically average approximately 4 months. The objective is to
receive a DISCHARGE where you will be relieved of most , if not all ,
of your debts. This will give you the FRESH START you are looking for!
A Trustee is appointed to determine your assets and liabilities and then
possibly liquidate some of your assets to pay your liabilities.
Be aware that you do not have to lose all of your property. Some Chapter 7 cases can be basic but some are very complex. We have
the experience to assist you throughout the entire process.
Chapter 13: This is considered to be "Reorganization." In this case, you
do not have to lose your property. CHAPTER 13 CAN ALLOW YOU TO KEEP YOUR
HOUSE, CARS AND OTHER PROPERTY. It can last between 3 to 5 years.
Chapter 11 Bankruptcy: This type of bankruptcy is also considered to be "Reorganization."
It used to be available to businesses only, but now individuals or couples
can use it. Chapter 13 has some limitations including a maximum amount
of debt you may have and the length of time you have in the 13 plan (5
years). Many individual 11 cases are filed to assist people with such
a high amount of arrears on their home mortgage that it would be impossible
to pay it back in 5 years. For example, a couple with a$100K in arrears
on their home could have 10 or more years to pay the $100K back instead
of 5 years.
